Terms of Use

1. Acceptance of Terms

Welcome to the UK Driving Test Audio app ("App") provided by Driving Better AI Limited ("Company," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the App, including any content, functionality, and services offered on or through the App.

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

2. Description of Service

The App is designed to assist users in preparing for UK driving theory and practical tests by providing:

  • Audio simulations of driving examiner instructions and guidance
  • Practice questions based on official DVSA materials
  • Multi-language support and various voice options
  • Educational content and study materials

All content is derived from official Driver and Vehicle Standards Agency (DVSA) sources and commercially licensed materials. The App is for educational and practice purposes only and does not constitute official driving test preparation or guarantee success in any driving examination.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have parental or guardian consent.

The App is available internationally, but some features may be restricted based on your location due to local laws and regulations.

4. User Accounts and Registration

Certain features of the App may require you to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. User Obligations and Prohibited Uses

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works of the App
  • Use the App to distribute harmful, offensive, or illegal content
  • Interfere with the App's security features or attempt unauthorized access
  • Use automated tools to access the App without permission

You are responsible for your use of the App and must exercise good judgment. The App does not replace official driving instruction or professional training.

6. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by the Company, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the App, except as permitted by these Terms or with prior written consent from the Company.

7. Content Sources and Licensing

Our content is sourced from reliable and official sources:

  • DVSA Show Me/Tell Me questions: Official DVSA page
  • Examiner guidance: Official DVSA guidance
  • Audio content generated using Eleven Labs (commercially licensed)
  • Images sourced from Unsplash and other licensed providers

While we strive for accuracy, content may not reflect the most current DVSA requirements. Always verify with official sources.

8. In-App Purchases and Subscriptions

The App may offer in-app purchases, subscriptions, or premium features. All purchases are processed through third-party payment providers (such as Apple App Store or Google Play Store) and are subject to their terms and conditions.

  • Subscription fees are billed in advance on a recurring basis
  • You can cancel subscriptions through your account settings or app store
  • Refunds are subject to the app store's refund policy
  • We do not guarantee uninterrupted access to premium features

9. Third-Party Services and Analytics

The App may contain links to third-party websites, services, or applications that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

We use Firebase Analytics to collect anonymous usage data to improve our App and understand how users interact with our features. This includes information about app usage patterns, feature adoption, and performance metrics. Firebase Crashlytics is used to collect crash reports and error information to help us identify and fix technical issues.

Your interactions with third-party services are solely between you and such third parties. We encourage you to review the terms and privacy policies of any third-party services you use.

10. Data Collection and Analytics

To improve our App and provide you with the best possible experience, we collect certain information about your use of the App. This includes:

  • Device information and app usage patterns
  • Feature usage and interaction data
  • Audio playback and content engagement metrics
  • Crash reports and performance data

By using the App, you consent to this data collection for the purposes described above. You can opt out of analytics collection through your device settings, though this may limit our ability to improve the App.

11. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The App is for educational purposes only and does not constitute professional driving instruction, legal advice, or official endorsement. Driving test requirements and procedures may change without notice. You should always consult official DVSA resources and qualified driving instructors.

The Company does not guarantee that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS LESS.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your violation of these Terms or your use of the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of England and Wales.

For users outside the UK, you agree that any legal action or proceeding shall be brought exclusively in the courts of England and Wales, and you hereby consent to the jurisdiction of such courts.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the App.

17. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms operate to the fullest extent permissible by law.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the App and supersede all prior agreements and understandings.
